79 37 38 Legislating for Sustainable Fisheries Duty to Cooperate To ensure effective conservation and management of straddling and highly migratory fish stocks, all states that are party to the agreement must, in accordance with Article 8(1), pursue cooperation to this end either directly or through an appropriate RFO. Article 8(3) obliges states to give effect to their duty to cooperate in managing these fish stocks by participating in RFO measures. However, only those states that have a “real interest” in the fisheries concerned may become members of such an organization.
