That case was decided in 1981, however, more than 25 years ago. Standardized tests are much better now, and students are given sufficient notice of the effect of their test scores. Recent court decisions establish that standardized testing requirements—even those that carry important consequences— do not violate constitutional or statutory rights.
43 The previous two chapters showed that No Child Left Behind requires states to have more high-stakes tests. This is done to ensure that students are learning the basics in reading, math, and science. There are other forms of high-stakes testing in schools: Many states now require students to pass some sort of exit exam before they can obtain their diploma. This means that students must achieve a certain score on the test to obtain their diplomas. Much criticism of standardized testing is simply not well founded.
